Residence permit in Estonia

Residence permits in Estonia are classified as being either temporary or permanent. Temporary residence permits for third country nationals are handed out based on what reason the person will be immigrating to Estonia. Permanent residence permits are given to those who have lived in Estonia under a temporary residence permit for five years or more.

Conditions for issuing permanent residence permit

A permanent residence permit may be issued to a foreigner if the foreigner:

*)meets the conditions of entry set in Schengen Borders Code;

*)has a valid document evidencing he has sickness insurance coverage when, in the cases established by the Government of the Republic of Lithuania, he is not covered by compulsory health insurance, or, in the cases and according to the procedure established by the Government of the Republic of Lithuania, he has the confirmed commitment of a citizen of the Republic of Lithuania or a foreigner residing in the Republic of Lithuania to pay charges for health care services provided to him during his residence period in the Republic of Lithuania;

*)has adequate means of subsistence and/or receives regular income which is sufficient for his stay in the Republic of Lithuania

Who is issued with permanent residence permit

A foreigner may be issued a permanent residence permit if:

*) the foreigner has retained the right to citizenship of the Republic of Lithuania according to the procedure established by the Republic of Lithuania Law on Citizenship;

*) the foreigner is a person of Lithuanian descent;

*)the foreigner has entered the Republic of Lithuania for residence together with a citizen of the Republic of Lithuania as his family member;

*)the foreigner has lost citizenship of the Republic of Lithuania but resides in the Republic of Lithuania;

*)the foreigner is a child under the age of 18, born in the Republic of Lithuania and his parents or one of the parents are citizens of the Republic of Lithuania whose place of residence has been declared in the Republic of Lithuania or who holds a permanent residence permit;

*)the foreigner is a child under the age of 18, born outside the Republic of Lithuania and his parents or one of the parents are citizens of the Republic of Lithuania whose place of residence has been declared in the Republic of Lithuania or who holds a permanent residence permit;

*)the foreigner has been granted refugee status in the Republic of Lithuania;

*)the foreigner has been residing in the Republic of Lithuania uninterruptedly for the last five years holding a temporary residence permit (the foreigner has to pass an examination in the state language and in the basic principles of the Constitution of the Republic of Lithuania as well as the procedure for the issue of the relevant certificates shall be established by the Government the Republic of Lithuania)**;

*)the foreigner submits the judgment certifying the juridical fact that the foreigner resided in the Republic of Lithuania until 1 July 1993 and is residing in the Republic of Lithuanian at the moment***.

Temporary Residence Permits

Estonian temporary residence permits come in many forms. Temporary residence permits can be granted for purposes of employment or business, settling with a spouse or close relative already resident in Estonia, for study, or for living in Estonia after proving that person can support himself or herself.

A temporary residence permit may be issued to a foreigner:

*)for employment and for enterprise;

*)for study according to the application of an educational institution;

*)in order to settle with a close relative permanently resident in Estonia;

*)whose permanent legal income ensures his/her subsistence in Estonia;

*)whose application for a residence permit is based on an international agreement;

*)who is married to a person permanently resident in Estonia.

A residence permit may be extended, if the basis for the issue of the residence permit has not changed and the application is justified.

Long-term residence permit may be issued to a foreigner if he or she comply with the following requirements:

*)has stayed in Estonia permanently on the basis of temporary residence permit for at least five years;

*)holds valid residence permit;

*)has registered residence in Estonia;

*)has permanent legal income for subsistence in Estonia;

*)is covered with health insurance;

*)complies with the integration requirement, i.e. has knowledge of the Estonian language at least at basic level.

How to otbain residency permit in Lithuania

Non-European Union citizens, willing to engage in certain activities in Lithuania like studies or work must apply for and receive a temporary residence permit. If a temporary residence permit on studies is issued, non-European citizen enjoys the right of possible part-time work which according to the Labor Code is not more than 20 hours per week. Depending on the reasons of residing in Lithuania, the temporary residence permit may be issued for a period not longer than 5 years through the local migration office.

Regarding the work permit, registered enterprise in Lithuania may emloy. Regarding the work permit, registered enterprise in Lithuania may employ a foreigner if he has a valid work permit issued by the Lithuanian Labor Exchange. Residence permit is not mandatory for EU citizens, as well as for foreigners holding a permit for permanent residence, foreigners who retained their right to the citizenship of the Republic of Lithuania, foreigners of Lithuanian origin and foreigner who has married Lithuanian citizen.

Temporary residence permit may grant a right to receive a work permit. The work permit is not required for persons who holds a position of head of the company in Lithuania but actually resides outside Lithuania.
