Residence permit in Lithuania

Non-EU citizens wishing to reside in Lithuania must receive a permit. Permits shall grant a right for temporary or permanent residence in Lithuania.

Temporary residence permit

A temporary residence permit is a document granting an foreigner the rights to reside in the Republic of Lithuania for an indicated period of time, specified in the permit. A temporary residence permit in the Republic of Lithuania is issued to an alien who is a citizen of a non-EU Member State. It is usually issued for a period of one year, though it may also be issued for a shorter period. In respect of the persons of the Lithuanian descent and the aliens who have retained the right to citizenship of the Republic of Lithuania, the temporary residence permit is issued for a period of five years.

A temporary residence permit in Lithuania shall be issued with regard to the following cases:

*)the foreigner has retained the right to citizenship of the Republic of Lithuania;

*)family reunification;

*)the foreigner intends to study, work, or engage in lawful activities in Lithuania.

The alien may change their place of residence in Lithuania, depart from and return to Lithuania during their permit validity period.The foreigner must give a notice of a change in his place of residence to a migration office of a public police division at a territorial police agency and should not forget that, under the Law on Declaration of the Place of Residence, a person must declare his departure when leaving from the Republic of Lithuania for a period exceeding six months.

Who may receive a temporary residence permit

Article 40 of the Law on the Legal Status of Aliens,stipulates the following grounds for the issuance of temporary residence permits to aliens.

A temporary residence permit may be issued to an alien if :

*) the alien has retained the right to citizenship of the Republic of Lithuania,

*) it is a case of family reunification,

*) the alien intends to work in the Republic of Lithuania,

*) the alien intends to engage in lawful activities in the Republic of Lithuania,

*) the alien intends to study,

*) the alien has been put under guardianship/custody,

*) the alien is or has been a victim of human trafficking and co-operates with the pre-trial investigation body or with the court in the fight against trafficking in human beings or in combating the offences linked to trafficking in human beings,

*) the alien intends to carry out scientific research.

An alien may also be issued a temporary residence permit where he has been granted subsidiary or temporary protection in the Republic of Lithuania, he is unable to depart due to a dangerous health condition and requires urgent basic medical aid, also where the alien cannot be expelled from the Republic of Lithuania.

The aim of resisdence and necessary documents

Permanent residence permit

Permit of a long-term resident of the Republic of Lithuania to reside in the European Community (hereinafter – permanent residence permit) – means a document entitling an alien to reside in the Republic of Lithuania and certifying the alien’s permanent resident status.

Permanent residence permit is a permit of a long-term resident of the Republic of Lithuania to reside in the European Community, it means a document entitling an alien to reside in the Republic of Lithuania and certifying the alien’s permanent resident status.

A permanent residence permit in Lithuania shall be issued for a period of five years. It shall prove the foreigners permanent resident status.

A permanent residence permit in Lithuania may be issued for an foreigner if she or he has married with a citizen of Lithuania and arrived in Lithuania to reside. The similar permit may be issued to a person who arrives in Lithuania and is a family member of an foeigner who has retained the right to citizenship of Lithuania in compliance with the procedure established by the Law on Citizenship, or if the foreigner is a person of Lithuanian descent.

Persons

Persons issued with permanent residence permit.

A foreigner may be issued a permanent residence permit if:

*) the foreigner has retained the right to citizenship of the Republic of Lithuania according to the procedure established by the Republic of Lithuania Law on Citizenship (Family members entering for residence with the alien and residing under his roof shall be issued permanent residence permits);

*) the foreigner is a person of Lithuanian descent(Family members entering for residence with the alien and residing under his roof shall be issued permanent residence permits);

*) the foreigner has entered the Republic of Lithuania for residence together with a citizen of the Republic of Lithuania as his family member;

*) the foreigner has lost citizenship of the Republic of Lithuania but resides in the Republic of Lithuania;

*) the foreigner is a child under the age of 18, born in the Republic of Lithuania and his parents or one of the parents are citizens of the Republic of Lithuania whose place of residence has been declared in the Republic of Lithuania or who holds a permanent residence permit;

*) the foreigner is a child under the age of 18, born outside the Republic of Lithuania and his parents or one of the parents are citizens of the Republic of Lithuania whose place of residence has been declared in the Republic of Lithuania or who holds a permanent residence permit;

*) the foreigner has been granted refugee status in the Republic of Lithuania;

*) the foreigner has been residing in the Republic of Lithuania uninterruptedly for the last five years holding a temporary residence permit (the foreigner has to pass an examination in the state language and in the basic principles of the Constitution of the Republic of Lithuania as well as the procedure for the issue of the relevant certificates shall be established by the Government the Republic of Lithuania.

*) the alien submits the judgment certifying the juridical fact that the alien resided in the Republic of Lithuania until 1 July 1993 and is residing in the Republic of Lithuanian at the moment. The alien has to prove in court that he/she: has lawful means of subsistence in the Republic of Lithuania; pays income tax and other taxes or fees established by laws or other legal acts of the Republic of Lithuania; has a place of residence in the Republic of Lithuania.

Conditions

Conditions for issuing permanent residence permit.

A permanent residence permit may be issued to a foreigner if he or she:

*) meets the conditions of entry set in Schengen Borders Code;

*) has a valid document evidencing he has sickness insurance coverage when, in the cases established by the Government of the Republic of Lithuania, he is not covered by compulsory health insurance, or, in the cases and according to the procedure established by the Government of the Republic of Lithuania, he has the confirmed commitment of a citizen of the Republic of Lithuania or an foreigner residing in the Republic of Lithuania to pay charges for health care services provided to him during his residence period in the Republic of Lithuania;

*) has adequate means of subsistence and/or receives regular income which is sufficient for his stay in the Republic of Lithuania.

Documents

Documents to be submitted to receive permanent residence permit.

To obtain permanent residence permit, person submits the following documents:

*) pre-defined application to issue permanent residence permit;

*) valid travel document;

*) documents confirming the right to obtain permanent residence permit;

*) documents confirming that person has sufficient funds and, or receives a regular income sufficient to cover living expenses in the Republic of Lithuania.

How to otbain residency permit in Lithuania

Non-European Union citizens, willing to engage in certain activities in Lithuania like studies or work must apply for and receive a temporary residence permit. If a temporary residence permit on studies is issued, non-European citizen enjoys the right of possible part-time work which according to the Labor Code is not more than 20 hours per week. Depending on the reasons of residing in Lithuania, the temporary residence permit may be issued for a period not longer than 5 years through the local migration office.

Regarding the work permit, registered enterprise in Lithuania may emloy. Regarding the work permit, registered enterprise in Lithuania may employ a foreigner if he has a valid work permit issued by the Lithuanian Labor Exchange. Residence permit is not mandatory for EU citizens, as well as for foreigners holding a permit for permanent residence, foreigners who retained their right to the citizenship of the Republic of Lithuania, foreigners of Lithuanian origin and foreigner who has married Lithuanian citizen.

Temporary residence permit may grant a right to receive a work permit. The work permit is not required for persons who holds a position of head of the company in Lithuania but actually resides outside Lithuania.
